Acceptance of Terms

By downloading or playing Alien Planet ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the App.

These Terms constitute a legally binding agreement between you and FortyTwoWarehouse LLC ("we," "us," or "our").

Use of the App

Alien Planet is a mobile arcade game for entertainment purposes. You agree to use the App only for lawful purposes and in a manner consistent with these Terms.

• You must be at least 4 years old to use this App. If you are under 13, you must have parental permission.
• You are responsible for any username you choose
• You agree not to use offensive, hateful, or inappropriate usernames
• You agree not to attempt to manipulate, hack, or cheat the leaderboard
• You agree not to reverse engineer, decompile, or attempt to extract the source code of the App

Usernames & Leaderboard

When you set a username it becomes visible on the public leaderboard. By choosing a username you confirm:

• You will not use your real full name or personal identifying information
• Your username does not violate any third party rights
• Your username is not offensive, discriminatory, or inappropriate

We reserve the right to remove any username that violates these Terms without notice.

Intellectual Property

All content in Alien Planet including but not limited to graphics, sounds, game design, code, and branding is owned by FortyTwoWarehouse LLC and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, lease, or create derivative works without express written permission.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial entertainment.

Leaderboard & Scores

Scores submitted to the leaderboard are public and visible to all players. We reserve the right to remove scores, reset leaderboards, or ban users that appear fraudulent, manipulated, or obtained through cheating, automation, or exploits. Decisions about score removal and account actions are final.

Account Termination

We may suspend or terminate your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the App ceases immediately.

Advertising

Alien Planet may display advertisements through third-party advertising networks such as Google AdMob. These ads are provided by third parties and we are not responsible for their content, accuracy, or any transactions resulting from them. By using the App you consent to the display of advertisements.

Disclaimer of Warranties

Alien Planet is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

Limitation of Liability

To the maximum extent permitted by law, FortyTwoWarehouse LLC shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages (including loss of profits, data, or goodwill) arising from your use of or inability to use the App, even if advised of the possibility of such damages. Our total aggregate liability shall not exceed the amount you paid for the App in the 12 months preceding the claim, or $100, whichever is less.

Indemnification

You agree to indemnify, defend, and hold harmless FortyTwoWarehouse LLC, its officers, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.

Apple and Google App Store Terms

If you downloaded the App from the Apple App Store, you acknowledge that these Terms are between you and FortyTwoWarehouse LLC only, not Apple Inc. Apple is not responsible for the App or its content. Apple is a third-party beneficiary of these Terms and may enforce them against you.

If you downloaded the App from the Google Play Store, you acknowledge that these Terms are between you and FortyTwoWarehouse LLC only, and that Google's own terms may also apply. Google is not responsible for the App or its content.

You agree to comply with all applicable third-party terms (including app store terms) when using the App.

Changes to Terms

We may update these Terms of Use at any time. We will notify users of significant changes by updating the effective date at the top of this page. Continued use of the App after changes constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the App.

Governing Law and Disputes

These Terms of Use shall be governed by and construed in accordance with the laws of the State of Michigan, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the App shall be resolved in the state or federal courts located in Michigan, and you consent to the personal jurisdiction of such courts.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
